PuntAla Camping Resort – Guest Contract

Dear Guest ,
Although there is no specific law obliging us to draft the Residence Contract in Italian, we feel it is appropriate that the version to be signed should be drafted in this language, also by way of confirming the mutual intention of the parties to have the contract governed by Italian law.   For reasons of transparency, please find a true copy of the contract below.
 
 TITLE I – Preliminary provisions
1. Ownership and Subject - 1. The “PuntaAla Camping Resort” campsite is owned by the company Campeggio Puntala S.r.l., with registered office in Castiglione della Pescaia, Punta Ala district, VAT number and Tax Code 01233070539, hereinafter referred to as “Campeggio Puntala”.

2. Campeggio PuntAla supplies its guests with the camping service as defined in art. 29 of Tuscan Regional Law no. 42 of 23 March 2000, enacted in articles 21-34 of the Decree of the President of the Republic (D.P.R.G.) no. 18/r of 23 April 2001.
 
TITLE II - Procedures
CHAPTER I - Supply of the service
SECTION I - Persons eligible for the service
2. Admission - 1.The camping service is supplied exclusively for family units consisting of a minimum of two (2) and a maximum of six (6) members.  
2. No groups or parties of any kind are admitted.  
3. A specific area has been set aside for young people aged under 25 who are not members of or visitors to a family unit staying in the camping resort.
3. Visitors- 1. Guests are allowed to welcome visitors inside the camping resort.
2. Visitors are admitted only during the opening hours of the Reception Office, and subject to payment of the fee due.
3. Minors are not admitted as visitors unless accompanied by adults who shall be responsible for supervising their behaviour throughout the entire period in the camping resort, and who shall be liable for all legal purposes towards Campeggio Puntala and towards third parties.
SECTION II – Bookings and lengths of stay
4. Booking restrictions- 1. With the exception of certain special offers available online, it is not possible to book stays of less than 7 nights.
2. The periods of stay begin on: Fridays, Saturdays or Sundays for the mobile homes and bungalows, depending on type, and Saturdays for the pitches in category A/B and for the tent pitches.
5. Booking charge - 1. The booking charge is Euro 42.00, non-refundable, and includes the travel insurance.
6. Deposits for holidays in the "Village" - 1. A deposit of 50% of the cost of stay (including person/nights) must be paid within one week of the booking request.  2. The balance owed must be paid at least 20 days prior to the beginning of the stay. 3. If the booking request is made within 20 days before the beginning of the stay, the entire amount owed must be paid on receipt of confirmation of the booking.
7. Deposits for holidays in the "Campsite" - 1. A deposit of 50% of the cost of the pitch (excluding person/nights) must be paid within one week of the booking request. 2. The balance owed must be paid at least 20 days prior to the beginning of the stay. 3. If the booking request is made within 20 days before the beginning of the stay, the entire amount owed must be paid on receipt of confirmation of the booking.
8. Right to withdraw - 1. The guest may cancel the booking at all times, by informing Campeggio Puntala in writing. 2. The cancellation shall entitle Campeggio PuntAla to withhold part of the deposit paid in the following proportions: a) 50% of the deposit paid if the cancellation is made between the date of booking and the 30th day before the beginning of the period of stay; b) 80% of the deposit paid if the cancellation is made between the 29th day and the 15th day before the beginning of the period of stay; c) 100% of the deposit paid if the cancellation is made after the deadline specified in letter b) above
9. Length of stay - 1. The booking is binding; at the beginning of the holiday the guest must pay the full amount even in the event of having the renounce part of the stay.
2. In the case of early departure, the rate applied for the remaining period shall be equal to the daily cost of two (2) adults and one (1) pitch.
4. The maximum period of stay cannot exceed 28 days. Any extensions of the period of stay must be expressly authorised by the Reception Office.
10. Transfer of the booking -1. The booking is a personal contract and may not be transferred by the guest to third parties for any reason.
11. Exclusions - 1. The Campeggio Puntala does not offer seasonal contracts.
12. Amendments - 1. By the first day of March each year, Campeggio Puntala reserves the incontestable right to update the prices of services based on the 100% change in the ISTAT (National Statistics Institute) index for the families of workers and employees with reference to the previous year, and/or the tax levy, and/or any other economic factor that has a significant impact on running costs.
2. Any bookings made before the date of said updating shall also be subject to the price adjustments made to the services.
  
CHAPTER  II - Check-in
13. Arrival and registration - 1. The reception of guests and the performance of the registration formalities at the Reception Office is permitted only during the times displayed at the entrance to the camping resort.
2. At the time of registration the guest and his or her visitors must provide Campeggio Puntala with their personal details; in the event of subsequent changes in relation to such visitors, the guest undertakes to inform Campeggio Puntala on the same day and sign the respective form held at the Reception Office.
14. Delays- 1. The guest is allowed a delay on the scheduled arrival time up to 12.00 noon on the following day, on condition that the delay is communicated by any suitable means to the Reception Office with at least 6 hours’ notice.
2. In the case of delay and up to arrival the guest is charged the daily rate for two (2) adults plus the cost of the pitch or the mobile homes or bungalow.
15. Key delivery ("Village" guests) - 1. The keys of mobile homes and bungalows are handed over at 17.00 on the day of arrival.
16. Assignment of pitches ("Campsite" guests) - 1. The guest is bound to occupy the pitch indicated to him or her at the Reception Office or to wait to be accompanied to the assigned pitch by a member of staff.
2. A special area of the camping resort is set aside for stays of less than 7 nights.
3. Occupation of a pitch other than that assigned is permitted only upon express written authorisation from the Reception Office in addition to a new registration procedure.
4. The pitches can be identified by numbered signs.
5. The guest must state the intended period of stay at the time of check-in. This period is binding; in the case of early departure, the rate applied for the remaining period shall be equal to the daily cost of two (2) adults and one (1) pitch.
  
CHAPTER  III - Check-out
17. Departure - 1. On the last day of stay, the guest must leave the camping resort at the following times:
- by 12.00, for those staying in campervans, caravans or tents;
- by 10.00, for those staying in mobile homes or bungalows.
18. Payment - 1. Payment of the fees for the stay, and for all other services for which payment is not made immediately, must be made during Cash Desk opening hours.
2. Payment must be made by the last day of the stay, except where requested in advance by the Management at its own discretion.
3. The guest is obliged to show the tax receipt as proof of payment to the personnel on duty at the exit of the camping resort.
4. Following the issue of the tax receipt the guest and/or his or her visitors cannot make any claim and/or complaint against Campeggio Puntala.
  
19. Security deposit - 1. At the time of registration, guests staying in mobile homes or bungalows are required to pay a sum of Euro 150.00 as a non interest-bearing security deposit to cover any damage caused to properties during their stay. This deposit will be returned on departure.
2. The above is without prejudice to the entitlement of the Campeggio Puntala to claim compensation for greater damages.
  
TITLE III – Rules of behaviour for guests and their visitors
CHAPTER  I - Prohibitions
20. Respect for the vegetation - 1. It is forbidden to tamper with the flora inside the camping resort in any way or by any means and to string up hammocks and/or clothes lines between the trees.  
2. In the event of ascertainment of such infringement, article 23, paragraph 2 of this contract shall apply, without prejudice to the application of article 36, paragraph 2 and article 37 of the same.
21. Lighting of fires - 1. It is prohibited to light open fires in any part of the camping resort and the respective appurtenances.
2. This is without prejudice to the stricter regulations issued by bodies in charge of heritage protection and conservation.
3. The use of the special masonry grill facilities provided inside the camping resort is permitted only on days where wind is moderate, not exceeding force 3 on the Beaufort scale (wind speed between 5.5 and 8 m/s) and scrupulously following the instructions displayed in these areas.
4. The use of gas stoves is permitted within the pitch as long as the stoves are positioned not less than one metre from the surrounding vegetation.
5. Smoking is forbidden in the buffer zone, that is in the area between the beach and the campsite pitches.
22. Waste disposal - 1. It is forbidden to dispose of waste except in the special containers delivered by the personnel of the camping resort, and disposal must comply with the legislation in force governing separate waste collection. Please refer to the Internal Regulations for details of the disposal procedure.
2. It is strictly forbidden to dispose of wastewater of any type or provenance except in the specifically indicated user stations located inside the camping resort (obligatory procedure for the drainage of caravan and campervan sewage) and/or in the toilet blocks.
23. Use of electricity cables and appliances - 1. It is forbidden to obstruct the roadways inside the camping resort with cables and/or any other equipment for electrical connections; it is similarly prohibited to place or hang such cables or equipment on the surrounding trees or plants.
2. The personnel of the camping resort are explicitly authorised to immediately and without notice detach any cable and/or other equipment s laid down in violation of the preceding paragraph. The same authorisation is granted in the case of electrical connections or plugs that are not compliant with current legislation.
3. It is forbidden to set up, or in any case to utilise, antennae or dishes of any kind designed for the reception of radio and television signals.
24. Use of sound equipment - 1. It is forbidden at any time of the day or night to use musical instruments or any other sound transmission system without using the appropriate headphones. By way of example, such systems may include but are not limited to: televisions, radios, computers, CD or DVD readers or cassette players.
25. Respect for the repose of others and rules of conduct - 1. It is forbidden to behave in a manner that could disturb the peace within the camping resort and its appurtenances, and also in the beach in front.
2. Within the silence periods, the times of which are displayed within the camping resort and also indicated in the Internal Regulations, it is forbidden to pitch or dismantle tents or other camping equipment, to speak in loud voices not appropriate to the repose which we aim to guarantee at such times, and to use machinery. Children are allowed to use the playground at all times. The management shall, at its own discretion, make exceptions for areas appointed to entertainment activities.
3. It is expressly prohibited to go either nude or “topless” within the camping resort. Children are not permitted to enter shops, bars or restaurants in the nude.
26. Pets - 1. Pets are not allowed into the camping resort.
27. Alterations to the pitch - 1. It is prohibited to alter the state of the assigned pitch in any manner whatsoever, except where such is made necessary by exceptionally inclement weather conditions that threaten the safety of people and/or things; in such cases the guest undertakes to immediately restore the pitch to its original condition as soon as the weather returns to normal, entirely at his/her own responsibility and expense.
28. Playgrounds - 1. Children aged over 12 are not allowed to use the playgrounds.
2. Only children accompanied by adults are allowed access to the playgrounds, and the adults are liable for the same to all legal effects and purposes in relation to Campeggio Puntala and to third parties.
  
CHAPTER  II - Access and use of vehicles inside the camping resort  
29. Cars - 1. The use of cars is authorised solely for operations of unloading of luggage and camping equipment upon arrival and of loading the same on departure.
2. The time limit for both such operations is 2 hours, except in the case of specific, written authorisation from the Reception Office.
3. In any case, in the hours between 13.00 - 15.00 and 23.00 - 07.00, or different time brackets indicated in the Internal Regulations, no mechanical vehicles are permitted to circulate within the camping resort and the respective appurtenances.
30. Campervans - 1. Only campervans that are duly approved by the competent authorities for overnight accommodation are permitted access to the camping resort. The personnel of the Reception Office are entitled to request the display of such documentation.
2. Campervans are permitted to leave the camping resort before 12.45 and must return before 22.45 on the same day. In any case in the hours between 13.00 - 15.00 and 23.00 - 07.00, or different time brackets indicated in the Internal Regulations, no mechanical vehicles are permitted to circulate within the camping resort and the respective appurtenances.
31. Restrictions - 1. Motorbikes and scooters of any engine capacity whatever and electric-engine vehicles are not allowed into the camping resort.
2. Bicycles are not allowed into the playgrounds.
32. Circulation - 1. The speed limit for all vehicles within the camping resort is 4 km/h.
2. The camping resort personnel are authorised to confiscate the bicycle of any minor found riding it at a speed greater than that established in the previous paragraph, or in such a manner as to cause danger to others. The bicycle will be returned to the adult in charge of the minor in question. If an adult rides a bicycle at a speed greater than the speed limit, he/she will be issued with a written warning, and in the case of repetition of the offence will be prohibited from using the bicycle within the camping resort.
33. Car parks - 1. The camping resort is equipped with special parking areas located in nearby appurtenances of the same.
2. It is absolutely prohibited to block the exit routes with vehicles of any kind, on pain of forcible removal. Should such obstruction be repeated for the third time with the same vehicle, it will be confiscated and returned to the owner at the end of the stay.
  
CHAPTER  III- Management of Emergencies
34. In case of fire – 1. There are specific alarm systems (sirens) inside the camping resort which, in the case of serious fire, emit three consecutive rings at regular intervals. When this happens, guests must proceed in an orderly manner to the “temporary muster stations” indicated by the signage and located on Via Costiera and Via PuntAla, where they should await the emergency team that will lead them to the general muster station at the entrance to the resort, which is indicated by special signs.
35. In case of other emergencies – 1. Related to health, serious natural events, situations of public safety, difficulties at sea: contact the campsite staff when available, or consult the notice board at the entrance where you will find all the phone numbers for requesting aid.
  
TITLE IV - Liability
36. Liability of the guest and/or of the visitors - 1. The guests and/or their visitors are personally liable towards Campeggio Puntala and/or third parties for any damage to persons and/or things, direct or indirect, caused under whatsoever entitlement as a result of conduct performed in violation of the regulations of this contract and/or other applicable legislation in force.
2. In the event of infringement of article 20, paragraph 1, a fine of Euro 50.00 will be payable to Campeggio Puntala for each individual violation; in the event of infringement of any of the obligations set down in article 21, paragraph 1 or article 33 paragraph 2, a fine of Euro 100.00 will be payable to Campeggio Puntala for each individual violation. The above is without prejudice to the entitlement of Campeggio Puntala to claim compensation for greater damages.
37. Termination - 1. The infringement of article 20, paragraph 1 first part, article 21 paragraphs 1, 2 and 5 and article 25 paragraph 1 of this contract entail the immediate termination of the same, with the obligation on the guest and his/her visitors to leave the camping resort within the 6 hours following receipt of the notice of termination, and by way of penalty clause, to pay the fee for the entire period of stay booked, even where not yet fully enjoyed, with the right of Campeggio Puntala to withhold the security deposit until its credit rights have been satisfied, and to claim compensation for the greater damages.
2. Any delay that goes beyond 12.00 noon of the day following the scheduled date of arrival, or the failure to provide notice pursuant to article 14, paragraph 1 of this contract, will similarly result in the immediate termination of the contract and the entitlement of Campeggio Puntala to claim compensation of the damages.
 
TITOLI V – Final provisions
38. Changes - 1. Any changes to the system of supply of the campsite services that is not in conflict with the rules of this contract is made public by posting on the specific Information notice board situated at the entrance to the camping resort.
2. Any variations that may be authorised for an individual guest shall be communicated to the same in writing, and the said document must be displayed whenever requested by the personnel of the camping resort.  Such exceptions do not entitle third parties to equivalent rights.
39. Disputes - 1. This contract is governed by Italian Law and for any interpretation pertaining to the clauses set forth in the same or for anything not specifically indicated herein, explicit reference is made to the legal regulations in force, or in their absence, to customary use and practice.
40. Assignment of the contract - 1. Following mergers, incorporations, company or branch transfers exclusively regarding Campeggio Puntala, this agreement, and the rights and obligations deriving from the same, shall be automatically transferred, without the need for the guest’s consent.
2. Campeggio Puntala does not accept the assignment of this contract to third parties by the guest.
41. General provisions - 1. Any tolerance by Campeggio Puntala of the behaviour of guests and/or their visitors that infringes what is laid down in this contract shall not be deemed waiver as regards the respective rights to which it is entitled on the basis of the said clauses.
2. In the event that any contract clause should, for any reason, prove not to comply with mandatory legal provisions, then it shall be without effect, albeit without prejudice to the validity of the remaining clauses.
3. This contract represents the full illustration of all the agreements between the parties and completely covers their rights and obligations in relation to the subject of the contract. Consequently any preceding or different written or oral agreement, either between the parties or in relation to third parties, is deemed null and void and without effect to the extent that it relates to this contract.
4. Any amendment to the terms and conditions of this contract must be made in writing on pain of invalidity.
